Residential Rental Tenancy Agreement Advice for Landlord Malaysia

There are thousands of online tenancy agreements available in Google search engine. But, is there any standard residential rental tenancy agreement format for landlord in Malaysia? The answer is no. There is no standard tenancy agreement in Malaysia. The agreement might variances from one to one depending on the deal between landlord and tenant. Therefore, it is important for both parties to understand the terms and conditions stated in tenancy agreement.

What are the important points to be considered in short term / long term tenancy agreement?

• Renewal terms and rates

It is flexible, depending on the deal between both parties. Notice period to be given before the expiry of the lease and how will be the new rental rates is charged shall be stated clearly.

• Payment of bills

Stated clearly who to pay and what bills to pay. Example: Water, electricity and sewerage (Indah Water). Tenant shall produce receipts showing that the said payments have been settled.

• Late payment charges / interest

To ensure that both landlord and tenant are mutually agreed and fully well aware about the late payment notice period. This is important to avoid any unnecessary argument on the late payment charges / interest later if happen.

• Home inventory list

List down all the furniture, electrical appliances, and whatever goods or products as provided. Do write down the product brand, model, serial number, color, and etc as much as you can to describe the best on it. It will be even better if you could snap photo for each of it. A photo represents thousand of words!

• Termination of tenancy agreement

Compensation amount and notice period shall be stated clearly if either party has intention to terminate the tenancy before the expiry date.
